1) Scope of application
1.1 These General Terms and Conditions (hereinafter "GTC") of Elke Heinitz & Benjamin Schmidt (hereinafter "Landlord") apply to all rental contracts concluded by a consumer or entrepreneur (hereinafter "Tenant") with the Landlord with regard to the rental properties presented on the Landlord's website. The inclusion of the Tenant's own terms and conditions is hereby rejected, unless otherwise agreed.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.
2) Conclusion of contract
2.1 The rental property described on the Landlord's website does not constitute a binding offer on the part of the Landlord, but serves to submit a binding offer for the conclusion of a rental agreement by the Tenant.
2.2 The Lessee can submit the offer via the online booking form integrated into the Lessor's website. By clicking the button that concludes the booking process, the Tenant submits a legally binding contractual offer in relation to the selected rental property. Furthermore, the tenant can also submit the offer to the seller by e-mail, fax, post or telephone.
2.3 The landlord can accept the tenant's offer within five days,
- by sending the Hirer a written booking confirmation or a booking confirmation in text form (fax or e-mail), whereby the receipt of the booking confirmation by the Hirer is decisive in this respect, or
- by requesting payment from the tenant after the booking has been made.
If several of the aforementioned alternatives exist, the contract is concluded at the point in time at which one of the aforementioned alternatives occurs first. The period for accepting the offer begins on the day after the tenant sends the offer and ends at the end of the fifth day following the sending of the offer. If the landlord does not accept the tenant's offer within the aforementioned period, this shall be deemed a rejection of the offer with the consequence that the tenant is no longer bound by his declaration of intent.
2.4 Before making a binding booking via the online booking form of the Rental Firm, the Hirer can correct his entries at any time using the usual keyboard and mouse functions. In addition, all entries are displayed again in a confirmation window before the binding booking is made and can also be corrected there using the usual keyboard and mouse functions.
2.5 Only the German language is available for the conclusion of the contract.
2.6 Bookings are generally processed and contact made by e-mail and automated booking processing. The Lessee must ensure that the e-mail address provided by him for the booking process is correct so that the e-mails sent by the Lessor can be received at this address. 3) Right of cancellation for consumers
There is no right of cancellation for contracts for the provision of accommodation services for purposes other than residential purposes if the contract provides for a specific date or period for the provision of services.
